Terms and Conditions for Membership Cancellation and Refunds

Effective Date: March 28, 2025

1. Definitions

For purposes of this Cancellation & Refund Policy:

  • "Month-to-Month Membership" means a recurring membership subscription billed monthly with no minimum term commitment.
  • "Committed Monthly Membership" means a membership with a fixed-term commitment (e.g., 12 months) billed on a monthly basis, as governed by a separate Membership Commitment Agreement.
  • "Annual Membership" means a membership paid in full for a twelve (12) month period in a single transaction.
  • "Early Termination" means cancellation of a membership before the end of its committed term.
  • "Remaining Balance" means the total of all unpaid monthly installments remaining under a Committed Monthly Membership from the date of Early Termination through the end of the commitment term.

2. Initial Purchases — All Sales Final

ALL INITIAL MEMBERSHIP PURCHASES ARE FINAL. Upon your initial enrollment in any PARennial Golf membership (Month-to-Month, Committed Monthly, or Annual), no refunds, credits, or cancellations with reimbursement will be provided for any reason, except as required by applicable law.

By completing your initial membership purchase, you acknowledge and agree that:

  • The transaction is final and non-refundable at the time of purchase.
  • You have reviewed and accepted the membership terms prior to purchase.
  • No "cooling off" period, grace period, or trial period applies to initial purchases unless explicitly stated in a promotional offer.
  • This policy applies regardless of whether you access or use the membership benefits.

The grace period provisions described in Sections 3 and 5 below apply only to automatic renewals, not to initial purchases.

3. Month-to-Month Membership — Renewal & Cancellation

Members enrolled in a Month-to-Month Membership may cancel at any time through their account settings or by contacting customer support. Upon cancellation:

  • Members retain access to all membership benefits until the end of the current billing period.
  • No refunds or credits will be provided for partially used billing periods.
  • Cancellation must be submitted prior to the next billing date to avoid additional charges.

Renewal Grace Period: We offer a forty-eight (48) hour grace period following each automatic monthly renewalduring which members may request a one-month credit for future use. This credit is non-transferable, non-refundable, and must be applied within twelve (12) months of issuance. This grace period does not apply to your initial purchase.

4. Committed Monthly Membership — Early Termination

IMPORTANT: Committed Monthly Memberships involve a binding financial obligation for the full commitment term as specified in your Membership Commitment Agreement.

If you elect to terminate your Committed Monthly Membership prior to the end of the commitment term ("Early Termination"), you acknowledge and agree to the following:

  • Early Termination Fee: You shall pay an Early Termination Fee equal to sixty percent (60%) of the Remaining Balance owed under your Membership Commitment Agreement. This fee represents a reasonable estimate of the damages incurred by PARennial Golf due to Early Termination and is not a penalty.
  • Payment: The Early Termination Fee shall be charged to your payment method on file within seven (7) business days of your cancellation request, or as otherwise agreed in writing.
  • Access Termination: Upon payment of the Early Termination Fee, your membership access will terminate immediately unless otherwise specified.
  • Failure to Pay: If the Early Termination Fee is not paid in full, PARennial Golf reserves the right to pursue collection of the full Remaining Balance, plus any applicable collection costs and interest permitted by law.

Example: If you have 6 months remaining on your commitment at $199.99/month, the Remaining Balance is $1,199.94. The Early Termination Fee would be $719.96 (60% of $1,199.94).

5. Annual Membership — Renewal & Refund Policy

Annual Memberships are billed in full at the time of purchase or renewal for the upcoming twelve (12) month period. Initial annual membership purchases are final and non-refundable (see Section 2).

Automatic Renewal: Annual Memberships automatically renew at the end of each twelve (12) month term unless cancelled at least seven (7) days prior to the renewal date.

Renewal Grace Period: We offer a forty-eight (48) hour grace period following automatic renewal only during which members may request a refund. Refund requests submitted within this grace period are subject to the following:

  • Administrative Processing Fee: A non-refundable administrative processing fee of Two Hundred Fifty Dollars ($250.00) shall be deducted from any refund issued.
  • Refund Amount: The refund amount shall equal the annual membership fee charged minus the $250.00 Administrative Processing Fee.
  • Processing Time: Approved refunds will be processed within ten (10) business days to the original payment method.
  • Access Termination: Upon refund approval, membership access will terminate immediately.

No Refunds After Grace Period: Except as required by applicable law, no refunds, prorated or otherwise, will be issued for Annual Memberships after the forty-eight (48) hour renewal grace period has expired. Members retain access to all membership benefits through the end of the paid term.

6. Billing, Renewal & Payment Authorization

By enrolling in any PARennial Golf membership, you authorize us to charge your designated payment method for:

  • Recurring membership charges according to your billing cycle
  • Any applicable taxes, fees, or surcharges
  • Any Early Termination Fees or Administrative Processing Fees as described herein
  • Any outstanding balances or amounts owed under your membership agreement

We reserve the right to modify membership fees upon thirty (30) days' prior written notice. Continued use of the membership after such notice constitutes acceptance of the modified fees.

7. Cancellation Process

To cancel your membership:

  • Sign in to your account via the PARennial Golf mobile app
  • Navigate to Membership Settings
  • Select "Cancel Membership" and follow the prompts
  • You will receive an email confirmation of your cancellation request

Important: Deleting the PARennial Golf mobile application, uninstalling software, or discontinuing use of the service does not constitute cancellation of your membership and does not relieve you of any payment obligations.

8. Post-Cancellation Access & Data

Following cancellation (and payment of any applicable fees):

  • You will maintain access to membership benefits until the end of any paid or committed period, unless otherwise specified.
  • After access terminates, your account will revert to a basic (non-member) status.
  • Account data will be retained in accordance with our Privacy Policy and applicable data retention laws.
  • You may re-enroll in a membership at any time, subject to then-current pricing and terms.

9. Disputes & Chargebacks

If you believe you have been charged in error, please contact us at play@parennialgolf.com within thirty (30) days of the charge. We will review your account and work to resolve any billing discrepancies.

Notice Regarding Chargebacks: By enrolling in a PARennial Golf membership, you acknowledge that initiating a chargeback or payment dispute with your financial institution for charges that are valid under this Policy and/or your Membership Commitment Agreement may result in: (a) suspension or termination of your membership; (b) collection action for the disputed amount plus any applicable fees; and (c) reporting to credit bureaus as permitted by law.

10. Governing Law & Jurisdiction

This Cancellation & Refund Policy shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any disputes arising under or related to this Policy shall be subject to the exclusive jurisdiction of the state and federal courts located in Cook County, Illinois.

11. Severability

If any provision of this Policy is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining provisions, which shall continue in full force and effect.

12. Entire Agreement & Amendments

This Cancellation & Refund Policy, together with our Terms of Service, Privacy Policy, and any applicable Membership Commitment Agreement, constitutes the entire agreement between you and PARennial Golf with respect to membership cancellation and refunds. We reserve the right to amend this Policy at any time by posting the revised version on our website. Your continued use of the membership after such posting constitutes acceptance of the amended Policy.
