Cancellation & Refund Policy

Terms and Conditions for Membership Cancellation and Refunds

Draft for Legal Review — Not Yet Effective

1. Definitions

For purposes of this Cancellation & Refund Policy:

  • "Monthly Flexible" means a recurring membership billed monthly with no minimum term commitment.
  • "Monthly Committed" means a membership with a fixed-term commitment billed in monthly installments, as governed by a separate Membership Commitment Agreement.
  • "Annual Unlimited" means a membership paid in full for a twelve (12) month period in a single transaction.
  • "Early Termination" means cancellation of a membership before the end of its committed term.
  • "Remaining Balance" means the total of all unpaid monthly installments remaining under a Monthly Committed membership from the date of Early Termination through the end of the commitment term.

2. Initial Purchases & Statutory Rights

Initial membership purchases are not covered by the courtesy automatic-renewal policy below. They are refundable when required by applicable law or when a written promotional offer expressly provides a refund or trial right.

Nothing in this Policy limits a cancellation, cooling-off, disability, relocation, facility-closure, or other right that cannot lawfully be waived. If applicable law gives you a more favorable right, that law controls.

  • You may submit a cancellation through Membership Settings or by emailing play@parennialgolf.com.
  • We will honor any additional method or deadline required by applicable law.
  • Legally required refunds are not reduced by this Policy's courtesy-refund processing-fee rule.

3. Monthly Flexible — Renewal & Cancellation

Monthly Flexible members may cancel future renewals at any time through Membership Settings or by emailing play@parennialgolf.com. Upon cancellation:

  • Members retain access to all membership benefits until the end of the current billing period.
  • Partially used billing periods are not ordinarily prorated, unless the courtesy policy below, a written promotion, or applicable law provides otherwise.
  • Cancellation must be submitted prior to the next billing date to avoid additional charges.

Courtesy Renewal Refund: If a Monthly Flexible membership renews automatically, you may submit a refund request within forty-eight (48) hours of the successful renewal charge. If eligible, we will refund the amount paid by card less the non-refundable third-party payment-processing fee recorded for that charge, restore PARennial Rewards used on the renewal, and end membership access when the refund succeeds. This courtesy is available once per member in a rolling twelve (12) month period and does not limit statutory rights.

4. Monthly Committed — Early Termination

IMPORTANT: Monthly Committed memberships involve a binding financial obligation for the full commitment term as specified in your Membership Commitment Agreement.

If you elect to terminate your Monthly Committed membership prior to the end of the commitment term ("Early Termination"), you acknowledge and agree to the following:

  • Early Termination Fee: You shall pay an Early Termination Fee equal to sixty percent (60%) of the Remaining Balance owed under your Membership Commitment Agreement. This fee represents a reasonable estimate of the damages incurred by PARennial Golf due to Early Termination and is not a penalty.
  • Payment: The Early Termination Fee shall be charged to your payment method on file within seven (7) business days of your cancellation request, or as otherwise agreed in writing.
  • Access Termination: Upon payment of the Early Termination Fee, your membership access will terminate immediately unless otherwise specified.
  • Failure to Pay: If the Early Termination Fee is not paid in full, PARennial Golf reserves the right to pursue collection of the full Remaining Balance, plus any applicable collection costs and interest permitted by law.

Example: If you have 6 months remaining on your commitment at $199.99/month, the Remaining Balance is $1,199.94. The Early Termination Fee would be $719.96 (60% of $1,199.94).

The courtesy automatic-renewal refund in Sections 3 and 5 does not apply to monthly installments due during a committed term. Statutory rights remain unaffected.

5. Annual Unlimited — Renewal & Refund Policy

Annual Unlimited memberships are billed in full at the time of purchase or renewal for the upcoming twelve (12) month period. Initial purchases are governed by Section 2.

Automatic Renewal: Annual Unlimited memberships automatically renew at the end of each twelve (12) month term unless you cancel before the next renewal charge is processed.

Courtesy Renewal Refund: If an Annual Unlimited membership renews automatically, you may submit a refund request within forty-eight (48) hours of the successful renewal charge. This courtesy is available once per member in a rolling twelve (12) month period.

  • Card Refund: We return the card-paid amount less only the non-refundable third-party payment-processing fee recorded for that renewal.
  • PARennial Rewards: Any PARennial Rewards used on the renewal are restored in full.
  • Original Payment Method: Card refunds are sent to the original payment method. Your bank determines when the credit appears.
  • Access Termination: Membership access ends when the payment processor reports that the refund succeeded. A pending refund does not end access.

After the Courtesy Window: Except as required by applicable law or an express written offer, no refunds, prorated or otherwise, will ordinarily be issued for Annual Unlimited memberships after the forty-eight (48) hour courtesy window has expired. Members retain access to all membership benefits through the end of the paid term.

6. Billing, Renewal & Payment Authorization

By enrolling in any PARennial Golf membership, you authorize us to charge your designated payment method for:

  • Recurring membership charges according to your billing cycle
  • Any applicable taxes, fees, or surcharges
  • Any Early Termination Fee described in a signed Monthly Committed Membership Agreement
  • Any outstanding balances or amounts owed under your membership agreement

Membership-fee changes apply prospectively. We will provide the notice, renewal disclosure, and consent opportunity required by applicable law before charging a changed amount.

7. Cancellation Process

To cancel your membership:

  • Sign in to your account via the PARennial Golf mobile app
  • Navigate to Membership Settings
  • Select "Cancel Membership" and follow the prompts; or email play@parennialgolf.com
  • Keep the confirmation email or support response for your records

Important: Deleting the PARennial Golf mobile application, uninstalling software, or discontinuing use of the service does not constitute cancellation of your membership and does not relieve you of any payment obligations.

8. Post-Cancellation Access & Data

Following cancellation (and payment of any applicable fees):

  • You will maintain access to membership benefits until the end of any paid or committed period, unless otherwise specified.
  • After access terminates, your account will remain available in a non-member account status.
  • Account data will be retained in accordance with our Privacy Policy and applicable data retention laws.
  • You may re-enroll in a membership at any time, subject to then-current pricing and terms.

9. Billing Questions & Disputes

If you believe you have been charged in error, please contact us at play@parennialgolf.com as soon as possible. We will review the agreement, charge, cancellation history, and account records and work to resolve any billing discrepancy.

Contacting us first may be the fastest way to resolve a question, but nothing in this Policy waives rights you may have with your card issuer, bank, payment network, regulator, or under applicable law.

10. Statutory Cancellation Rights

Consumer-protection laws may provide cancellation or refund rights in addition to this Policy. Those rights vary based on where you live, how you enrolled, and the services purchased. When applicable law is more favorable to you, it controls.

You may exercise applicable rights through Membership Settings, by emailing play@parennialgolf.com, or through any other method the law requires us to accept.

11. Governing Law & Jurisdiction

This Cancellation & Refund Policy shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any disputes arising under or related to this Policy shall be subject to the exclusive jurisdiction of the state and federal courts located in Cook County, Illinois.

12. Severability

If any provision of this Policy is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining provisions, which shall continue in full force and effect.

13. Entire Agreement & Amendments

This Cancellation & Refund Policy, together with our Terms of Service, Privacy Policy, and any applicable Membership Commitment Agreement, constitutes the entire agreement between you and PARennial Golf with respect to membership cancellation and refunds. Material changes apply prospectively and will be communicated using the notice and consent process required by applicable law.
